Heirloom Portraits Terms and Conditions

By purchasing an Heirloom Portrait Session, you agree to the following terms and conditions.

Model Release and Copyright
I grant to the Photographer, Sarah Erwin Photography, the right to take photographs of my children as deemed fit by the Photographer.  The Photographer shall own the copyright of all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website, blog, social mediate pages, and/or studio.  (Please note: if you are not comfortable with your photos being on social media or my website, please just shoot me an email and I will draw up a modified contract!)

Client's Usage
The Client’s images are for personal use only and shall not be submitted to contests, reproduced for commercial use or authorized in any reproductions by parties other than the Photographer.

Alteration of Images
Aside from cropping, no alterations should be made to the images without the written permission of the Photographer. Please do not apply filters from any program or social media.

Return of Images to Customer
The Photographer will return all agreed upon images within three weeks of the photography session.   Heirloom sessions include 5 digital images.  Digital images will be delivered in a private gallery which will stay online for two weeks.

Archive of Digital Files

Digital images will be archived by the Photographer for 6 months.

Tardiness
The photo session time will not be able to be extended if the client arrives late.  Tardiness may therefore result in reduced shooting time and less images presented by the Photographer.

No Show
Failure to show-up at a scheduled session, or any cancellation within 48 hours for any reason other than illness, will result in the retainer being forfeited.

Refunds
No refunds will be given for dissatisfaction with the images. Print products may not be returned for any reason other than damage or error on the part of the print lab. There are no refunds or exchanges on any digital products. 

Cooperation of Subject
The photographer requires the active and willing participation of each member of the photo shoot and is not responsible for missed shots due to lack of cooperation.

Loss of Pictures 
The Photographer takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that all the photographs have been lost, stolen, damaged or destroyed for reasons within or beyond the Photographer's control, the payment will be refunded in full.  Liability for loss of images is limited to the return of all payments received for the portrait package. The limit of liability for a partial loss of originals shall be a pro-rated amount of the package selected, based on the percentage of originals lost.  

Illness or Absence of Photographer
Photographer reserves the right to cancel the shoot due to illness, weather, equipment malfunction, or other emergency circumstances beyond their control.  In this unlikely circumstance, the Photographer and Client shall make every attempt to reschedule the session or provide a substitute photographer. If a reschedule or substitute is unable to be agreed upon, Photographer shall return the payment to the client. 

Limit of Liability
The Photographer's entire liability to the Client, models, or other companions for claim, loss, or injury arising from the photographer’s performance or negligence is limited to a refund to the Client in the amount paid for services.

By purchasing an Heirloom Portrait Session, I agree that I have read and agree to all contract terms above. I declare that I have legal authority to grant these permissions for all subjects involved in the photo session and accept all responsibilities for such.
